OFFICIALS TO WRITE TO (and samples of letters)

June ____________, 2011

The Honorable Thomas E. Perez
U.S. Department of Justice
Civil Rights Division
950 Pennsylvania Avenue, N.W.
Office of the Assistant Attorney General, Main
Washington, D.C. 20530

Dear Assistant Attorney General Perez:

We express gratitude to the Department of Justice for undertaking an investigation into the killing of Danroy “DJ” Henry in Westchester County, New York. The seemingly biased and inept investigation conducted by the various Police Departments involved, has offended our sense of justice and raised considerable doubts as to the integrity of the procedures followed in the handling of this case.

We trust that that the Department of Justice will use all of the resources at its disposal when investigating this matter to ensure that justice is served. This includes gathering information independently rather than relying on data received from local agencies, speaking directly to witnesses and accessing and viewing any and all electronic recordings of that evening’s events. Because without an exhaustive investigation into the possibility that misconduct may have been perpetrated on the part of the responding officers, we may never truly understand the events which took place and this matter may never fully be put to rest.

We urge the Department of Justice to demand transparency, accountability, and truthfulness from the officers involved and the police departments as a whole. We believe that these are the most fundamental code of belief of the service that law enforcement officers provide to our society, and it is only through the universal application of these values that we can ensure the fair and impartial administration of justice for all citizens.

Again, thank you for your commitment to this matter.

Respectfully Yours,

The Honorable Governor Andrew Cuomo
New York State Capitol Building
Albany, NY 12224

Dear Governor Andrew Cuomo:

I respectfully request and urge you to conduct a prompt and thorough investigation of District Attorney, Janet DiFiore and the District Attorney's Office of Westchester County regarding their investigation into the shooting death of Danroy (D.J.) Henry, the PACE University student who died on October 17, 2010 outside of a bar in Thornwood, New York.

I believe that the Mt. Pleasant Police Department was too closely involved with the tragic death of Danroy Henry to conduct a comprehensive and objective investigation of itself and the circumstances surrounding his death. A fact that District Attorney DiFore and her office should have been aware of. I am deeply concerned that their failure to persuade the Grand Jury to return a indictment against at least Officer Hess, did the public at large a grave disservice.

Honesty, integrity, professionalism and accountability are crucial to prevent the increasing erosion of public trust in Law Enforcement. Many dedicated police officers and officials manage to fulfill their duties in accordance with rules and laws daily. It is hard to imagine any greater violation of a citizen's civil rights beyond having that citizen lose his very life, when he had committed no wrong, and lose it to someone who took an oath to serve and protect, not maim and kill. Indictment of Aaron Hess was warranted and would have provided for a full and public airing of all facts and evidence, removed the cloak of secrecy and dishonesty.

Thank you for any and all attention that you are able to bring to this growing and serious issue that places all of us at peril and cost DJ Henry his life.

Sincerely,
